What the available records say

Summaries below draw on historical posts and the City records linked under Sources. An agenda item is a proposal; minutes are the record of Council action. Later developments may not yet be reflected here.

Odor complaints and corrective efforts

The September 14, 2026 Council minutes record residents raising odor concerns and a Fairlife representative describing tank-related mitigation steps. The representative said a lid was planned by the end of the first quarter of 2027. This was a company-reported plan, not independent confirmation of completion or effectiveness.

In a separate, formal July 7, 2026 violation notice, EGLE's Air Quality Division found that odors from Fairlife's wastewater equalization tank violated Michigan Air Pollution Control Rule 901 and General Condition 6 of its air permit. EGLE documented off-site odors and confirmed the equalization tank as the source following June 2026 complaints and investigation. This is a regulatory finding, not simply a resident complaint.

Regulatory engagement

Fairlife submitted its response to EGLE on July 27, 2026. The company reported adjustments to tank chemistry and airflow, planned an odor-neutralizing system, and described a future tank cover and other treatment improvements. These were company-reported measures and plans. The documents reviewed do not establish that EGLE accepted the response, closed the violation, or confirmed that the measures eliminated off-site odors.

Continental Dairy's separate milk-dryer air-permit findings and wastewater discharge-permit history should not be confused with Fairlife's specific Rule 901 odor notice.

Expansion and abatements

The city’s water infrastructure agreements and any future industrial tax exemption are distinct decisions. The October 19 millage article says additional information on the new Fairlife IFT request was still being sought.

Questions for the next update

  • Has EGLE accepted Fairlife's July 27, 2026 response to the July 7 Rule 901 violation notice, and what is the violation's current enforcement or closure status?
  • What is the timeline for each promised odor-control milestone and who confirms completion?
  • What commitments, jobs, taxable investment and revenue assumptions support any new tax-exemption request?
  • What written follow-up inspections or odor observations has EGLE completed, and what evidence demonstrates whether Fairlife's odor-control measures are effective?
